Agreement to these terms

These terms govern your use of bmistudios.com (the "site"), operated by BMI Studios ("BMI Studios," "we," "us"). By using the site you agree to them. If you do not agree, please do not use the site.

These terms cover the website only. Creative, production and other services we provide to clients are governed by the separate written agreement for that engagement, which controls if it conflicts with these terms.

Using the site

You may browse and share the site for lawful, personal or internal business purposes. You agree not to:

• use the site in a way that breaks any law or infringes anyone's rights;
• attempt to gain unauthorized access to the site, its content management system or the systems behind it, or interfere with their operation or security;
• send spam, malicious code or automated submissions through our forms;
• scrape, copy or harvest site content or data in bulk, including to build datasets or train AI models, without our written permission;
• misrepresent your identity or your affiliation with BMI Studios.

Our content and intellectual property

The site and its content, including text, images, video, design, logos and the BMI Studios name, are owned by BMI Studios or used under license, and are protected by intellectual property laws. Except as these terms allow, you may not copy, modify, distribute or create derivative works from them without our written permission.

Work shown in our portfolio may include brands, trademarks and materials that belong to our clients or other third parties. Those remain the property of their owners, and their appearance on the site does not grant you any right to use them.

What you send us

When you contact us or subscribe, you confirm that the information you provide is accurate and that you have the right to share it. Please do not send confidential material through the contact form; we will arrange an appropriate way to exchange it if a project goes ahead. If you send us ideas or feedback about the site, we may use them without obligation to you. Our handling of personal information is described in our Privacy Policy.

Information on the site

Articles, resources and other content on the site are general information about creative work and technology. They are not professional, legal or financial advice, and we do not guarantee that they are complete or current. Nothing on the site is an offer to provide services on particular terms; any engagement is set out in a written agreement.

The site links to websites and services run by others, such as social platforms. We are not responsible for their content, policies or practices, and your use of them is governed by their terms.

Disclaimer

The site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent the law allows, BMI Studios and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of or inability to use the site. Our total liability for any claim relating to the site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow these limitations, so they may not all apply to you.

Indemnity

You agree to indemnify and hold BMI Studios harmless from claims, losses and expenses, including reasonable legal fees, arising from your misuse of the site or your breach of these terms.

Governing law

These terms are governed by the laws of the State of Nevada, without regard to its conflict of laws rules. Any dispute relating to the site will be brought in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction.

Changes and termination

We may update these terms or change, suspend or discontinue any part of the site at any time. The date at the top shows when the terms last changed, and continuing to use the site after a change means you accept the updated terms. We may restrict access for anyone who breaks them. If any provision is found unenforceable, the rest remain in effect.
